Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of Stockboom, the website at www.stockboom.pro, and any related applications, notifications, and services (together, the “Service”). The Service is operated by m2m jobs, based in Amsterdam, the Netherlands (“Stockboom”, “we”, “us”, or “our”). By creating an account, or by accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What Stockboom is

Stockboom monitors publicly available statements made by high-profile people and surfaces notifications to its followers when one of them appears to make a public statement about a stock, sector, or theme. We may also show planned events (such as earnings calls, keynotes, and IPOs) and indicative market prices.

Stockboom is an information and alerting tool only. It is not a broker, dealer, investment adviser, financial adviser, exchange, trading venue, or fund. We do not execute trades, hold client money, or manage assets.

2. Not financial, investment, legal, or tax advice

Nothing provided through the Service is financial advice, investment advice, a personal recommendation, an inducement, an offer, or a solicitation to buy, sell, hold, or otherwise deal in any security or financial instrument. Content is provided for general information purposes only and does not take into account your personal circumstances, objectives, financial situation, or risk tolerance.

We do not provide legal, tax, accounting, or regulatory advice. You are solely responsible for your own investment decisions and should obtain independent professional advice and conduct your own research before making any decision. No fiduciary, advisory, or other special relationship is created between you and Stockboom by your use of the Service.

3. Investment risk

Investing carries risk, including the risk of losing some or all of your capital. Prices can move quickly and unpredictably. Past performance, examples, or any figures shown in the Service are not a reliable indicator of future results. Any reaction of a stock price to a public statement is uncertain and may not occur. You accept full responsibility for, and all risks associated with, any decisions you make based on, or in connection with, the Service.

4. Market prices and data are delayed and indicative

Any market prices, quotes, percentages, charts, or other market data shown in the Service are delayed, indicative, and provided for general information only. They must not be relied upon as accurate, complete, real-time, or as a true or official record of any price or value.

Market data may be sourced from third parties, may be subject to delays of an unspecified and variable length, may contain errors, gaps, or inaccuracies, and may differ materially from prices available on any exchange or through any broker. Do not use the data shown in the Service for trading decisions, valuation, or any purpose that requires accurate or timely pricing. Always verify prices with your broker or an official source before acting.

5. Signals, sources, and accuracy

Notifications (“signals”) are generated automatically, including by automated classification and machine-learning systems, from third-party and publicly available sources. These systems are imperfect. Signals may be incomplete, inaccurate, mistaken, misattributed, taken out of context, delayed, duplicated, or missed entirely. A statement may be satirical, hypothetical, conditional, historical, impersonated, fabricated, or otherwise not what it appears to be.

We do not verify, endorse, or guarantee the accuracy, authenticity, completeness, or timeliness of any statement, source, attribution, or signal, and we are not responsible for the content of third-party sources. References to any person, company, or security are for identification and information only and do not imply any endorsement, affiliation, or sponsorship.

6. No guarantee of timeliness or availability

While speed is a goal of the Service, we do not warrant that any signal will be delivered at all, within any particular time, in any particular order, or before any third party, market move, or news report. Delivery depends on third-party sources, networks, providers, and infrastructure outside our control. The Service is provided on an “as is” and “as available” basis and may be interrupted, suspended, delayed, or discontinued at any time.

7. Eligibility and your account

You must be at least 18 years old and legally able to enter into these Terms to use the Service. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity that occurs under your account. Notify us promptly of any unauthorised use. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction.

8. Acceptable use

You agree not to:

  • use the Service in breach of any applicable law or regulation, including securities, market-abuse, and market-manipulation laws;
  • resell, redistribute, scrape, republish, or commercially exploit signals, data, or other content without our prior written consent;
  • copy, modify, reverse engineer, or attempt to derive the source code of the Service, or interfere with its security or operation;
  • access the Service through automated means except as we expressly permit, or place an unreasonable load on our infrastructure;
  • use the Service to harass, defame, or harm others, or to transmit unlawful, infringing, or malicious content.

9. Plans, billing, and cancellation

Stockboom offers a free plan (limited notifications, email only) and a paid Premium plan with additional features and delivery channels. Current prices and limits are shown on the Service and may change. Paid subscriptions are billed in advance on a recurring basis through our payment processor (Stripe) and renew automatically until cancelled.

You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain Premium access until then. Except where required by law, payments are non-refundable and we do not provide partial-period refunds. By subscribing to digital content and services that begin immediately, you request immediate performance and acknowledge that, to the extent permitted by law, you lose any statutory right of withdrawal once performance has begun.

We may change prices, plans, or features. Where a change affects an active paid subscription, we will give reasonable notice, and the new price will apply from your next renewal.

10. Notifications and communications

By configuring alerts you consent to receive messages from us through your selected channels, which may include email, SMS, and WhatsApp. Message frequency varies and message and data rates may apply through your carrier. You can change or disable alerts in your settings, and you can manage marketing communications separately. Some messages (such as account, billing, security, and service messages) are necessary to operate the Service and cannot be opted out of while you hold an account.

11. Intellectual property

The Service, including its software, design, text, and branding (but excluding third-party content and the underlying public statements), is owned by Stockboom or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use in accordance with these Terms. All rights not expressly granted are reserved.

12. Third-party services and links

The Service relies on and may link to third-party services and sources (including data, news, payment, messaging, and hosting providers). We do not control and are not responsible for third-party services, their availability, content, or terms. Your use of a third-party service is governed by that party’s terms.

13. Privacy

We process personal data in accordance with applicable data protection law, including the GDPR. Details of what we collect and how we use it are set out in our Privacy Policy, which forms part of these Terms. You can delete your account from your settings.

14. Disclaimer of warranties

To the fullest extent permitted by law, the Service and all content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements or that any signal, price, or other content is accurate, complete, current, or reliable.

15. Limitation of liability

To the fullest extent permitted by law, Stockboom, its operator, and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, savings, data, goodwill, or investment losses or trading losses, whether or not foreseeable and whatever the cause, arising out of or in connection with the Service or these Terms.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Service or these Terms will not exceed the greater of (a) the total amount you paid us for the Service in the three months before the event giving rise to the liability, or (b) fifty euros (EUR 50). Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

16. Indemnification

You agree to indemnify and hold harmless Stockboom and its operator from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your investment or trading decisions, or your breach of these Terms or of any applicable law.

17. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, to comply with law, or to protect the Service or other users. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnities) will survive.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example by posting the updated Terms with a new “last updated” date or by contacting you. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

19. Governing law and disputes

These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Netherlands, without regard to conflict-of-law rules. The competent courts of Amsterdam, the Netherlands, will have jurisdiction, except where mandatory consumer law gives you the right to bring proceedings in your country of residence. Mandatory rights you have as a consumer are not affected by these Terms.

20. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or transfer of the business. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Stockboom regarding the Service.
